An overview of the fast immigration category to Canada

The Canada Express Entry system is the most common immigration system to introduce Canadian permanent residency and was introduced by the federal government in January 2015 to replace the “first come, first served” process.

What is Express Entry and how does it work?

Express Entry is not an immigration program per se, but rather an online system created to manage immigration applications to Canada.

Applicants who meet the eligibility criteria submit an online profile known as the Expression of Interest (EOI), as part of one of the three Canadian Federal Immigration Programs or a participating provincial immigration program, to the Express Entry Pool, an express immigration pool unit.

Candidates’ profiles are ranked against each other according to a point-based system called the Comprehensive Ranking System (CRS). Top-ranked candidates will be considered for the Invitation to Apply (ITA) for permanent residency. Those who receive an ITA must quickly submit a complete application and pay the processing fee within 90 days. The federal government aims to process all permanent residence applications within just 6 months.

How do you apply for an Express Entry immigration?

It is a two-step process:

Step 1: Create your online profile

Candidates who meet minimum entry criteria (including administrative and financial services, engineering, information technology and science, health professions, skilled trades, etc.), may obtain permanent residency through 347 professions, by submitting an Expression of Interest file to the Express Entry Pool.

Selection criteria include age, education, language skills, work experience, and other factors.

The profiles of the candidates in the pool are classified under a comprehensive classification system that measures their contribution to human capital in Canada.

Candidates who do not have a job offer or a provincial nomination can file an employment file with the Job Bank of Canada to search for a Canadian employer.

Step 2: Receive your invitation to apply for permanent residency

Canadian employers who are not able to reach any Canadians for employment are encouraged to submit a job offer to candidates of their choosing in the Express Entry Pool. Candidates with a regional nomination get the most points (600), while those with administrative job offers (National Occupation Classification 00) get 200 points, and those who have other job offers (NOC O, A, B) get 50 points.

The profiles of all candidates will be evaluated against others in the group. Top-ranked candidates will be considered in order to be invited to apply for permanent residency in Canada.

Candidates who receive an invitation must submit a complete application within 60 days. Invitations are issued during periodic draws throughout the year.

Successful applicants and their companions will be processed within approximately 6 months.

What will happen if you do not receive an invitation to apply for permanent residence?

The candidate profile will remain in the Express Entry Pool for a period of 12 months. After that, candidates who meet the minimum criteria can re-submit a new profile.

A two-step process

Step 1: Candidates submit an express entry profile online

Candidates who meet the minimum entry criteria express their interest in obtaining permanent residency by submitting an online profile to the Express Entry Pool.

Certified employers are encouraged to hire pre-screened Express Entry Pool candidates where there aren’t any Canadians available. Candidates appointed by the federal government are invited to apply for permanent residency.

Invitations are issued during periodic draws throughout the year. Candidates who receive an invitation must submit a complete application within 60 days.

The candidate’s profile stays in the Express Entry Pool for a period of 12 months. Successful applicants and their dependents are processed within 6 months.

Express Entry for skilled workers

An overview of Express Entry for skilled immigration

Skilled immigrant applicants can use the Canadian Express Entry system to become permanent residents of Canada. Express Entry system manages the applications of skilled workers and accepts applications from those who are likely to successfully settle in Canada and contribute to the advancement of Canada’s economy.

Immigration authorities intend to process 80% of applications under the Express Entry system within 6 months. There is no deadline for completing applicants’ profiles. There is also no cap on the number of express immigration applications that will be accepted. However, the numbers chosen each year will depend on the levels of annual immigration in Canada.

Skilled immigration applicants can use the Express Entry system to apply for permanent residency under one of four economic immigration programs.

  • Federal Skilled Worker Program.
  • Federal Skilled Trades Program.
  • Canadian Experience Class Program.
  • Provincial Nominee Program (specific components).

Applying for permanent residency through the Express Entry system consists of two steps.

Step 1: Create an express entry profile online

Applicants will use Express Entry profiles online to provide information to Citizenship and Immigration Canada regarding:

  • Work experience.
  • Education.
  • Language skills.
  • Qualifications.
  • Other personal information relevant to the evaluation of their application.

Those who meet the criteria for one of the three skilled immigration programs mentioned above will be accepted into a pool of candidates. It is important to note that successful acceptance of a pool of candidates does not automatically result in an invitation to apply for permanent residency (ITA). The acquisition of an ITA depends on the factors listed below.

Applicants who already have a job offer supported by a Labor Market Impact Assessment (LMIA), will have a higher chance of obtaining an ITA. Those who have been nominated for permanent residency by the provincial government will also have an increased chance of success. Candidates who do not have a job offer, LMIA, or provincial nomination can register with Canada’s Job Bank for Employment and Social Development. However, this is not a requirement. The job bank will help bring candidates in contact with employers. Candidates should also use other independent means to search for work while they are on the candidate pool.

Step 2: Get an invitation to apply for permanent residency (ITA)

All Express Entry Pool applicants will be ranked against each other using a points-based system called the Comprehensive Ranking System. Under the ranking system, applicants are awarded points based on:

  • Their skills
  • Work experience.
  • Whether they have a job offer.
  • Whether their job offer is supported by an LMIA.
  • Whether they were nominated for permanent residency by the provincial government.

The ITA will be offered to the candidates who obtain the highest CRS scores. Once the candidate obtains the ITA, he will have 90 days to submit an online application for permanent residency.

Candidates who do not receive an ITA may stay in the candidate pool for a period of 12 months. After 12 months in the Express Entry Pool, candidates must create a new Express Entry Pool profile online. Candidates will not be allowed to create a new profile unless they continue to meet the relevant criteria of their chosen immigration program.

Comprehensive Ranking System (CRS)

All skilled immigration applicants who qualify for the Express Entry System will be placed in the Candidate Pool. Candidates are then ranked into the group using the Comprehensive Ranking System (CRS). The CRS is used to determine which applicants in the pool will be invited to apply for permanent residency.

CRS is a score-based system that assigns a score to a candidate based on the information on a candidate’s profile. These scores allow the candidates in the group to be ranked against each other.

Applicants are awarded points based on the following factors:

  • Skills.
  • Work experience.
  • Language ability.
  • Language ability and education of the applicant’s spouse or common law partner.
  • Obtaining a job offer backed by a positive evaluation of the labor market impact.
  • Obtaining a provincial government nomination for permanent residency.
  • Certain combinations of language skills, education, and work experience that lead to an applicant’s greater chance of becoming employed (skill transferability).

Using these factors, applicants will be awarded a maximum score of 1,200 points. The highest-ranked applicants will be invited to apply for permanent residency (ITA) during the draws period.

CRS prioritizes applicants who are likely to settle successfully and have a positive economic impact in Canada. For this reason, having an approved job offer or a provincial permanent residence candidacy will have a very positive impact on an applicant’s degree.

Having an approved job offer in a management field (National Occupation Classification 00) is worth 200 points, while all other job offers (NOC O, A, B) are worth 50 points. The two point assignments will greatly enhance the candidate profile.

Provincial nomination will automatically award an applicant with 600 points. This allocation of points will almost always ensure that the candidate receives an invitation to apply for permanent residency.

Invitations to Apply for Permanent Residency (ITAs)

Applicants who receive an ITA will be eligible to apply for permanent residency in Canada. Applicants who receive an ITA will also receive a letter from Immigration and Citizenship Canada indicating which immigration program they should apply through and how to apply for permanent residency. It is important to note that obtaining an ITA does not automatically mean that the applicant will be accepted as a permanent resident. After obtaining the ITA, the applicant must submit a completed application for permanent residency. This application will be accepted or rejected depending on whether the applicant meets the required criteria or not.

Note: Applicants receiving ITA may be required to prove that the information they entered in their express entry profile is correct. If it appears that the applicant provided wrong information in his personal file, the application will be rejected and the applicant may be subjected to another penalty such as:

  • Rendering him inadmissible to Canada.
  • Preventing him from entering Canada in any form for a period of five years.

Applicants who receive an ITA will have 90 days to apply for permanent residency. During the 90-day period, it is recommended that applicants ensure that they complete the following:

1. Check your language test results

Applicants must verify that their language test results will still be valid on the day they submit their permanent residence application. Language test results are valid for two years. If the test results are to expire before the application is submitted, applicants must either:

  • Retake the test.
  • Ensure that their requests are submitted before the results expire.
  • Decline their invitation to submit

2. Get a police certificate

Applicants for permanent residency must obtain a police certificate for themselves and for all family members over the age of 18 years. In addition, every family member must obtain a police certificate from every country in which he/she lived for more than six months when he/she was over the age of 18. In order for these police certificates to be processed, applicants must start obtaining certificates as soon as possible.

3. Check the program requirements

Once applicants have determined which skilled immigration program they will be applying to, they must confirm that they meet the requirements for that program.

4. Update personal information

Applicants whose personal status has changed since receiving the ITA should recalculate their CRS score using the online tool that can be found here. If the applicant’s new score is much lower, it is recommended that the applicant decline the ITA.

If the applicant applies for permanent residency and finds that his/her grades are no longer high enough, the application will be rejected and the paid fees will not be refunded. Changes that could lower an applicant’s score include:

  • Loss of a job offer
  • Loss of the provincial nomination for permanent residency
  • Expired language test results
  • New language test results are lower than previous results

Note: The addition of a common-law spouse or partner can increase or decrease the applicant’s score based on the following requirements of the spouse or partner:

  • Language skills
  • Education
  • Chances of becoming successful in Canada

ITA applicants who do not apply for permanent residency within 90 days will be removed from the pool of candidates. Applicants removed from the pool will have to create a new Express Entry profile and be accepted into the pool again in order to obtain a new ITA.

5. Declining the Invitation To Apply (ITA)

As we saw above, in some cases, applicants who decline their ITA will be better served. Applicants who reject their ITAs will be returned to the pool of candidates as long as they remain eligible for the Express Entry system. While at the pool, applicants must ensure that their personal information is kept up to date. Candidates in the pool should also look for opportunities to increase their overall ranking score by:

  • Obtaining a job offer
  • Obtaining a permanent residence nomination by the provincial government
  • Improving their language test scores

Declining an ITA in itself doesn’t necessarily affect the applicant’s chances of obtaining another ITA in the future.
Candidates who do not respond to the invitation to apply by either accepting or declining will be removed from the Express Entry Pool.
